RELEASE OF LIABILITY, TERMS, CONDITIONS AND DISCLAIMERS


The User agrees to comply with all posted rules and regulations relating to the use of, but not limited to, the Gym Facilities, Conference Space, and their components at the property at The Avanti Wyndham Resort & Conference on i-Drive. The User also agrees to assume all responsibility for compliance with these rules.
The User agrees that participation in any Bombshell Productions activities involves the risk of injury. The User agrees to assume all risk of injury that may be sustained by the User or others resulting from the use of the course, equipment, and facilities, and further agrees to assume all risk of damage to personal property owned by the User or others resulting from the use of the course, equipment, or facilities.
The User also agrees to waive any and all claims, causes of action, damages, proceedings, and lawsuits against Bombshell, Inc., its subsidiaries, and affiliates (collectively referred to as “indemnities”), and to fully release, indemnify, and hold harmless the indemnities from any and all damages, losses, claims, causes of action, suits, judgments, and other liabilities resulting from or relating to the User’s use of the course, equipment, and facilities, or resulting from any injury sustained by the User or others, or damage to personal property owned by the User or others.
Any controversy or claim arising out of or relating to the User’s use of the equipment or facilities, or arising out of this Waiver and Release, shall be settled by arbitration in Orange County, Florida, administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.


PHOTOGRAPHY RELEASE


I hereby give Bombshell, Inc., BSF Productions, its assigns, licensees and legal representatives the irrevocable right to use my name / photograph / image / audio recording / video recording / and likeness (“My Image”) in all forms and manner including but not limited to publication on Internet Web Sites, social media advertising, broadcasts and any other publications as released to or by Bombshell, Inc. and BSF Productions. I understand that Bombshell, Inc. and its affiliates cannot control unauthorized use of My Image by persons not associated with Bombshell, Inc. once My Image has been published. I hereby forever waive any right to inspect or approve any publication of My Image by Bombshell, Inc.. I have carefully reviewed and understand the above provisions and agree to be bound by them. I voluntarily and irrevocably give my consent and agree to this Release and Waiver.


GENERAL PROVISIONS


You agree that any claim, action or lawsuit (collectively, “Action) arising out of the Terms and Conditions, products, and services provided in connection with Bombshell Productions,, its’ subsidiaries, assigns, officers, and employees must be filed and maintained exclusively in any court in Orange County, Florida having subject matter jurisdiction with the prevailing party being entitled to reasonable attorneys’ fees. You also hereby submit to the personal jurisdiction of such courts for the purposes of litigating any such Action. You agree that these Terms and Conditions, Services, and Products shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any principles of conflict law.
